Terms of Service

Effective date: 2026-07-19

These Terms of Service ("Terms") govern your use of dev-mux (the "Service"), a managed control plane for tmux and AI coding agents. By creating an account or using the Service you agree to these Terms.

1. The Service

dev-mux provisions and operates a per-tenant virtual machine ("managed hub") that runs the dev-mux control plane. You connect your own machines ("spokes") and your own AI coding agents. The Service orchestrates sessions; your code stays on your machines — see the Privacy Policy for the precise data posture (content transits hub RAM but is never stored at rest).

2. Accounts

You are responsible for your account credentials, for the auth keys you paste during onboarding, and for all activity under your account. You must provide accurate account information and keep it current.

3. Plans, billing, and cancellation

4. Acceptable use

Your use of the Service is subject to the Acceptable Use Policy ("AUP"), which is incorporated into and forms part of these Terms. The AUP prohibits, among other things, cryptocurrency mining and other resource abuse, network abuse, and unlawful activity, and it describes the technical guardrails (egress caps and CPU-anomaly alerts) that protect the Service. You agree to comply with the AUP. Violating the AUP is a breach of these Terms.

5. Monitoring boundary

We monitor only system-level and external signals to keep the Service healthy and to enforce the AUP. We do not read your session content. The full operator monitoring boundary is described in §4 of the Privacy Policy.

6. Suspension and termination

We may suspend or terminate access for breach of these Terms or the AUP, for non-payment, or where required to protect the Service or third parties (for example, active abuse under the AUP). You may stop using the Service and cancel at any time under the Refund Policy. On termination, your managed hub is torn down per the schedule in §2 of the Privacy Policy.

7. Incorporated policies

The following documents are incorporated into these Terms by reference:

8. Warranties and liability

The Service is provided "as is" and "as available," without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the claim.

9. Changes to these Terms

We may update these Terms; we will update the effective date and notify account holders of material changes. Continued use after changes take effect constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of Rhode Island, United States, without regard to its conflict-of-laws rules. You and dev-mux submit to the exclusive jurisdiction of the state and federal courts located in Rhode Island for any dispute arising out of or relating to these Terms or the Service.
